You Can’t try me again Senator Kalu tells the federal government

The former Governor of Abia state, Senator Orji Kalu, has pray the court to prohibit the anti-graft agency EFCC from trying him the second times

He asked the court to stop his trials on the same allegation of money laundering which he has already be triad and convicted and eventually sentence to 12 years imprisonment. In an ex parte move before Justice Ekwo, Kalu, said he has been tried before and sentence by the same court on the same charge FHC/ABJ/CR/56/2007. SENATOR Kalu, said it will amount to double jeopardy if he was subject to a fresh trial on the same case

The motion was moved by his counsel  Awe Kalu (SAN) before justice Ekwo, the ex governor asked for an order prohibiting the federal Government, through the anti-graft agency and other sister agencies  from retrying him on the same case that he has been sentence before for 12 years.

 “An order granting leave to the applicant to apply for an or of prohibition, prohibiting the Federal Government, the EFCC, (her agent), her officers, servants, others, agents, privies and any other person or bodies deriving authority from the Federal Government, from retrying him on charge No.FHC/ABJ/CR/56/2007 between FRN vs Orji Uzor Kalu & two others or any other charge based on the same facts de novo, there being no extant judgment and ruling of a competent court in Nigeria mandating same.”

The case resumed yesterday after the Supreme Court quashed the one previously given by a federal high court in Lagos that sentence senator Kalu to 12 years imprison, for money laundering, and a retrial was ordered.
