Sen. Iyorchia Ayu, the embattled PDP national chairman, has called the alleged suspension of him by Igyorov Ward executive members of the Gboko Local Government Area (LGA) in the state of Benue, an exercise in futility. Ayu claimed he had not been suspended in a statement released by his special adviser on media and communications, Simon Imobo-Tswam, in Abuja. Ayu claimed that he had heard rumors that the Executive Committee of his Ward had suspended him. Thus, we want to say unequivocally and emphatically that “The PDP National Chairman, Ayu, has not been suspended by his Ward.  Certain Exco members are being teleported by political gamblers just for the purpose of causing trouble. To begin with, the PDP Constitution as it was amended in 2017 (Article 57(7)) clearly forbids any party organ or executive committee at the ward or state level from instituting any disciplinary action against a member of the party’s National Executive Committee. The alleged suspension is consequently a fruitless exercise because it is largely supported by blatant ignorance, gambling, and desperation.  It only has value for mischief, drama, and propaganda. The alleged suspension letter, according to Ayu, was created by an illiterate and was only delivered to the members who had been forced to sign it in Makurdi. The original date is tippexed and 24 March is placed on it because of this. According to what we know, the document is false since the Ward Executives’ signatures were either falsified or coerced. The letter was not signed by the chairman, his deputy, or the legal advisor.  The fourteenth name on the list didn’t sign either.  The same holds true for Numbers 5, 8, and 16. The others forced, threatened, and persuaded members of the Exco to appear in Makurdi when they were actually in their villages going about their daily lives. According to Ayu, nine executives are still being held captive in a place in Makurdi for understandable reasons. He continued, noting that it was instructive that their cell phones had been turned off, as was to be expected. He urged the general people to disregard reports to that horrifying effect, claiming that those responsible were merely investing in costly illusions. The ward executive reportedly suspended Ayu on Sunday due to allegations of anti-party activity, inability to pay his annual subscription fees, and failure to cast a ballot in the recently finished elections. The suspension reports further claimed that: As a result of the PDP’s appalling performance in Igyorov Ward, it was also found that the majority of his closest allies worked for the opposition party, the All Progressives Congress (APC). In light of the aforementioned, we hereby vote against Dr. Iyorchia Ayu and suspend him from the party with immediate effect, the letter had stated.  The suspension is in place as of March 24, 2023.

Friday night, the Court of Appeal in Abuja rejected an appeal by the Peoples Democratic Party that sought to have Bola Tinubu of the All Progressives Congress and Kashim Shettima, who would have been his running mate, disqualified from the election on February 25. The PDP failed to prove that it had locus standi to bring the lawsuit, according to a three-member panel led by Judge James Abundaga. According to the News Agency of Nigeria, the PDP made an appeal that was marked: The case, CA/ABJ/CV/108/2023, had pleaded with the appellate court to overturn the Federal High Court of Abuja’s Jan. 13 verdict handed by Judge Inyang Ekwo, which had dismissed the case on the grounds that the PDP lacked locus standi to bring the action. The Independent National Electoral Commission, the APC, Tinubu, and Shettima were respondents in the appeal, with the PDP serving as the appellant. The Tinubu/Shettima presidential ticket was challenged by the PDP in a lawsuit that was filed on July 28, 2022. It claimed that Shettima had received two nominations and that her selection as the running mate violated Sections 29(1), 33, 35, and 84(1)(2) of the Electoral Act of 2022 (as modified). It stated that Shettima had not resigned or withdrew his nomination as a candidate for the Borno Central Senatorial election at the time he was nominated as a vice presidential candidate. Shettima’s candidacy as a vice presidential candidate and as a senatorial contender for Borno Central, according to the party, was illegal. The PDP also sought to the court for an order to invalidate Tinubu, Shettima, and the APC’s eligibility to run in the presidential election set for February 25. In addition, it asked the court to issue an order directing INEC to strike their names from the list of nominated or supported candidates who are qualified to run for office. The defendants asked the court to dismiss the case for lack of jurisdiction in their preliminary objection. They argued that the plaintiff lacked locus standi to bring the lawsuit since it always contested APC decisions and candidate nominations, which fell under the purview of the party’s internal affairs and were therefore outside the purview of the court’s jurisdiction. In the lead opinion, Judge Abundaga characterized the PDP as a busy body that dabbled in matters that were APC internal business. He concurred with the arguments made by attorneys for the respondents, notably Thomas Ojo of Lateef Fagbemi and Co. The trial court’s determination that the PDP had failed to prove its locus standi was correct, according to Judge Abundaga. He then went on to support the FHC’s decision by stating, “The appellant, having failed to reveal its locus standi, this appeal fails and is accordingly dismissed.” The judge also fined J. O. Olotu, the appellant’s attorney, N5 million in costs.
